Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Presently application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the App.

2. Description of Service

Presently is a digital wellness application that helps users manage screen time through app blocking, focus sessions, scheduling, daily habit tracking, and usage analytics. The App is available for iOS devices and uses Apple's Screen Time and DeviceActivity frameworks.

3. Account & Authentication

You may sign in using Apple Sign In. You are responsible for maintaining the security of your account. You agree to provide accurate information and to notify us of any unauthorized access.

4. Subscriptions & Payments

Presently offers a free tier and a premium subscription (“Presently Pro”). Subscriptions are billed through Apple's In-App Purchase system.

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
• You can manage or cancel subscriptions in your Apple ID settings
• Refund requests should be directed to Apple

5. User Conduct

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to circumvent security features of the App
• Redistribute or resell the App or any part of it

6. Intellectual Property

The App, including its design, code, and content, is the intellectual property of Presently. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Screen time data accuracy depends on Apple's frameworks.

8. Limitation of Liability

To the maximum extent permitted by law, Presently shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of productivity, or inability to access blocked applications during emergencies.

9. Emergency Access

Strict Mode may prevent access to certain applications. The Emergency Unlock feature is available for urgent situations but has a 24-hour cooldown. You are responsible for ensuring you can access essential services (e.g., emergency calls, critical communications) at all times.

10. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion, your personal data will be removed within 30 days. Active subscriptions should be cancelled separately through Apple.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the App. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law.

14. Apple Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. Apple is not responsible for the App or any content thereof and has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
